About Aubay
This reason, all personal data is processed and protected in accordance with the applicable legislation: EU Regulation 2016/679, General Data Protection Regulation (GDPR) and Law 58/2019 of 8 August.
This Privacy Notice explains who we are, for what purposes we may process your personal data, how we process it, to whom we may disclose it, such as customers, public entities and/or other Aubay Group Companies, where it may be transferred or which3 may access it and what your rights are.
Aubay Portugal, S.A. (hereinafter referred to as "Aubay Portugal" or "Aubay"), will process your personal data (also referred to herein as "information") in accordance with the purposes described below.
Aubay Portugal is the entity responsible for the processing of your personal data relating to the use of your personal data.
Your personal data will be processed only for the following purposes:
Why do we need this information?
Compliance with legal obligations
It includes the processing of personal data strictly necessary to comply with legal obligations, such as the disclosure of data in compliance with court orders, collaboration with supervisory and regulatory entities, and the protection of Aubays' legitimate rights.
Recruitment
It includes recruitment activities such as searching, selecting and placing Aubays' clients in Portugal, as well as related activities. In this context, data processing will also apply to payroll processing and human resources management.
Execution of Contracts
It includes activities such as entering into contracts with customers and partners, as well as communicating to third parties involved in the contracts (insurance companies, beneficiaries, intermediaries) and responding to requests from customers and partners.
Service Development and Improvement
It includes the activities necessary for the development and improvement of the services provided by Aubay Portugal, analysis and processing of the activity for statistical and scientific purposes.
How will my information be used?
Lawfulness of the processing of personal data
Personal data will only be used if one of the following occurs:
1. You have given your consent by signing or accepting an online or paper form.
2. The data are necessary for the fulfilment of legal, contractual or pre-contractual obligations relating to the employment relationship.
3. The data is necessary to comply with a legal obligation to which Aubay is subject, such as the disclosure of data to the Tax Administration and Social Security, as well as other authorities
4. The data are necessary for the purposes of the legitimate interests pursued by Aubay, provided that they do not prevail over the interests or rights, freedoms and guarantees of the data subject.
Personal data will not be used for purposes other than those described in this information notice, without having been previously informed or, where appropriate, obtained your consent.
Personal data will be processed by Aubay Portugal through the application of technical and organizational measures that guarantee a high level of security, in accordance with the GDPR.
In relation to job seekers, Aubay defines and analyzes behavior profiles in order to provide a better service for the selection and recruitment of human resources.
How long will you keep my information?Personal data will be kept for the minimum period necessary and proportional to the pursuit of the purposes described above.
Regarding recruitment processes, and under the terms of labour legislation, your personal data will be kept for a period of 2 (two years).
Will my information be shared with others?
Some personal data may be disclosed:
1. Within the aubay Group of Companies. Aubay Portugal is part of a multinational business group. Your data may be disclosed to other group companies in the context of the provision of shared services between group companies and for internal reporting purposes;
2. To Aubay Customers. In the context of human resources recruitment services and the provision of temporary work;
3. To Aubay's third-party service providers. Aubay uses several third parties to provide services, which may have access to your data;
4. To Public Authorities. Under the terms of the applicable law, Aubay is obliged to disclose data to the Tax Administration, Social Security, the Working Conditions Authority, and, following court orders, to the judicial authorities.
In accordance with this privacy policy, the use of your information may involve the transfer of your information to other countries.
What are my rights?
At any time, you can ask us to:
1. Access to your personal data;
2. Updating your personal data;
3. Oppose, delete or limit the processing of your personal data;
4. The portability of your personal data in a structured, compatible and readable format.

Your requests will be treated with care in order to ensure the effectiveness of the rights. We may ask for proof of your identity to ensure that the sharing of personal data is only with the data subject.
Please note that in certain cases, under applicable law, the request may not be immediately or fully fulfilled. In any case, you will be informed of the measures taken to that end within one month of the time the request is made.
You also have the right to lodge a complaint with the national supervisory authority: www.cnpd.pt.
Can I revoke consent at a later time?
If consent is legally required for the processing of personal data, the data subject has the right to withdraw consent at any time.
However, this right does not compromise the lawfulness of the processing carried out on the basis of the consent previously given, as well as the subsequent processing of the same data, on another legal basis, such as the fulfilment of the contract or the legal obligation to which Aubay is subject.
